Cruisly Terms of Use

These Terms of Use govern your use of the Cruisly website and application.

In these Terms, “Cruisly”, “Voyagr”, “we”, “us” and “our” refer to Voyagr Technologies Ltd.

By creating a Cruisly account, you agree to these Terms.

Please read them before registering.

The current Cruisly beta is available to people aged 18 or over.

By creating an account, you confirm that you are at least 18.

Cruisly is a personal cruise-logbook and cruise-companion service.

It allows users to record past and upcoming cruises, keep personal cruise information and explore statistics derived from their saved cruising history.

Cruisly is currently an early-stage service and features may continue to develop.

Unless explicitly stated otherwise, Cruisly is not a travel agent, cruise operator or booking provider.

You must provide accurate information when creating an account.

You are responsible for:

• keeping your login credentials secure;
• protecting access to the email account associated with Cruisly;
• informing us if you reasonably believe your account has been compromised; and
• activity carried out through your account where that activity results from your failure to keep your credentials secure.

You must not create an account using another person’s identity without permission.

Cruisly allows you to enter information about your cruises.

You are responsible for the accuracy and appropriateness of information you add.

You should not enter information that you do not have the right to store or share.

Do not use Cruisly to store payment-card numbers, passport information, passwords, medical information or other highly sensitive information.

If you add information about a travel companion or another person, you are responsible for ensuring that the information is appropriate for you to record.

You retain ownership of information and content that you add to Cruisly.

You give Voyagr Technologies Ltd permission to host, store, process, reproduce and display that content only to the extent reasonably necessary to operate, secure and provide Cruisly to you.

This permission ends when the relevant content is deleted, subject to temporary retention in system backups and any legal retention obligations.

We do not claim ownership of your personal cruise records.

You must not use Cruisly:

• unlawfully or fraudulently;
• to impersonate another person;
• to interfere with the security or operation of the service;
• to attempt to gain unauthorised access to another user’s account or information;
• to probe, attack, reverse engineer or circumvent security controls except where applicable law expressly permits it;
• to upload malicious software or code;
• to abuse, overload or deliberately disrupt Cruisly’s systems;
• to infringe another person’s intellectual-property, privacy or other legal rights; or
• for activities that could reasonably expose Cruisly or other users to harm.

We may take reasonable action to protect the service and its users where these rules are breached.

Some Cruisly information may be entered by users or obtained from third-party or publicly available sources.

Cruise itineraries, ports, sailing dates, ship facilities and travel arrangements can change.

You should verify important travel information directly with the relevant cruise line, travel provider, port, government authority or other authoritative source before relying on it.

Cruisly should not be used as your sole source for safety-critical, visa, immigration, medical, financial or travel-entry decisions.

Cruisly may contain links to third-party websites or services.

Those services are operated independently from Cruisly and may have their own terms and privacy practices.

We are not responsible for third-party services where a problem arises from their acts or omissions rather than ours.

The Cruisly name, branding, interface, software, original design elements and original content provided by Voyagr Technologies Ltd are owned by us or used under licence.

These Terms do not transfer those rights to you.

You may use Cruisly for your personal, lawful use in accordance with these Terms.

We aim to provide a reliable service, but Cruisly is currently an evolving product.

We may carry out maintenance, fix faults, improve features and make reasonable changes to the service.

We do not promise that Cruisly will always be uninterrupted or error-free.

Where reasonably practicable, we will try to minimise significant disruption.

We may add, remove or change features as Cruisly develops.

We will not use these Terms to remove rights that consumers are entitled to under law.

If a change materially affects an existing user’s rights or use of the service, we will provide reasonable notice where appropriate.

Cruisly’s current beta may include features provided without charge.

We may offer optional paid features or subscriptions in future.

If we do, the applicable price, billing terms, cancellation rights and any additional conditions will be shown clearly before you agree to purchase them.

These Terms do not authorise Cruisly to charge you for a service unless you have separately agreed to that charge.

You can delete your Cruisly account at any time through your account settings.

We may restrict or suspend an account where reasonably necessary because:

• these Terms have been seriously or repeatedly breached;
• we reasonably believe the account is being used fraudulently;
• doing so is necessary to protect Cruisly, its users or its systems; or
• we are legally required to do so.

Where appropriate and reasonably possible, we will explain the reason and give you an opportunity to address the issue.

We may permanently close Cruisly as a service in future. If that happens, we will provide reasonable notice where practicable and allow users a reasonable opportunity to export their data before closure.

Nothing in these Terms affects rights that you are entitled to under applicable consumer law.

Services supplied to consumers must comply with applicable legal requirements, including requirements relating to reasonable care and skill where they apply.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that:

• were not reasonably foreseeable when you agreed to these Terms;
• result from information that you entered incorrectly;
• arise from a third-party service where we were not responsible for the relevant act or omission; or
• result from circumstances genuinely outside our reasonable control, subject to your legal rights.

Cruisly is intended primarily for personal consumer use.

We do not exclude or limit responsibility where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Our use of browser storage and similar technologies is explained in the Cookie & Similar Technologies Policy.

We may update these Terms as Cruisly develops or where laws and regulatory requirements change.

The latest version and effective date will always be made available through Cruisly.

If a change is significant, we will provide reasonable notice where appropriate.

If you do not agree with materially revised Terms, you may stop using Cruisly and delete your account.

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.

If you are a consumer living elsewhere in the United Kingdom, you may also have the right to bring proceedings in the courts applicable to the part of the UK in which you live.
